What the CEO argued

Michael's argument was that AbbVie no longer needs the Humira era to be over before the next decade is funded: a quarter that beat its own midpoint by $0.06 on adjusted EPS and grew revenue 10.2%, with Skyrizi, Rinvoq and the whole neuroscience portfolio each above 20%, is what pays for a $10.9bn purchase of Apogee Therapeutics whose assets he framed squarely at "AbbVie's performance in the 20 thirties and beyond". He absorbed the deal's $0.14 of 2026 dilution into guidance rather than carving it out, said the balance sheet still has room for more business development, and on the one question that governs the whole thesis — how long Skyrizi is protected — he put the composition-of-matter expiry at 2033, later US patents into the mid-2030s, and regulatory data protection running to 2031, so no biosimilar filings before the end of this decade.

SKYRIZI's composition of matter patent expires in 2033 as you noted, we do have later expiring IP granted and in process that embodies SKYRIZI's significant innovation. And this includes patents expiring in The US in the mid 20 thirties and later. Now it is important to note, though, that regulatory data protection for SKYRIZI does not expire until 2031, so we do not expect to see biosimilar application filings until the end of this decade.
